UK Tier 2 Visa

The UK Tier-2 visa offers a pathway for skilled professionals to settle and grow their careers in the UK for a 5-year period. The UK Tier-2 visa is managed by the points-based system where candidates 70 points for the application. The points are given based on the factors given below:

  • Candidates with a Certificate of Sponsorship (CoS) from a Canadian employer.
  • Candidates must meet the salary requirements.  
  • Candidates must demonstrate English language proficiency.
  • Candidates must provide sufficient proof of funds.

 

The UK Tier 2 visa is further segregated to facilitate different professionals, which are mentioned below:

  • Tier 2 General Visa: Designed for individuals with a job offer in the UK and whose profession is listed on the shortage occupation list (now replaced by the Skilled Worker visa).
  • Tier 2 Intra-Company Transfer Visa: Intended for employees of corporations relocating to the UK.
  • Tier 2 Minister of Religion Visa: Tailored for ministers of religions affiliated with a religious organization.
  • Tier 2 Sportsperson Visa: Specifically for coaches and sports professionals.

 

Processing Time of UK Tier-2 visa

The visa application can be submitted three months prior to the start date of your employment in the UK. The joining date is usually mentioned in the Certificate of Sponsorship (CoS) by the UK-based employer.

The decision on the visa is usually announced within 3 weeks of submitting the application. The processing time for most of the UK visas are set to be streamlined, considering the recent addition of occupations to the Shortage Occupations List (SOL).

 

UK Tier 2 visa validity

The visa allows a maximum stay of 5 years, contingent upon the length of your employment contract. If you haven't reached the maximum duration for your visa type, extending your stay is possible. Applying for an extension can be done online or at a premium service center for UK visas.

Under the Tier 2 visa, the maximum duration is 5 years and 14 days or the duration specified on your certificate of sponsorship (plus 1 month), whichever is shorter.

 

UK Tier-2 visa Requirements

The candidates must have the following list of requirements to apply for the UK Tier-2 visa:

  • Valid Certificate of Sponsorship
  • Proof of sufficient funds
  • English language proficiency
  • Criminal clearance certificate
  • Any other additional documents

 

UK Tier-2 Visa- Dependent Visa

The Skilled Worker Dependent Visa is designed for the children and partners of individuals who have either arrived in the country on a Skilled Worker visa or have applied for one.

Eligible candidates for a Skilled Worker Dependent Visa include:

  • Spouse
  • Unmarried or same-sex partner
  • Children below 18 at the time of application
  • Children over 18 who are dependents

For spouses and partners, the relationship must be legal, and they should reside together throughout their stay in the country.

  • Financial Requirements: Skilled Worker dependents do not have access to public funds. Hence, they must demonstrate sufficient financial resources for their stay in the UK. If there are dependents, an additional £630 must be shown for each dependent.
  • Age: Both the principal applicant and the dependent must be at least 18 on the date of arrival in the United Kingdom or when the visa is issued.
  • Additional Criteria: Previous holders of UK visas for students or short-term study visas since April 2015, or those granted leave as parents of a Tier 4 student (child) since April 2015, are ineligible.

Meeting the general grounds for admission is essential, necessitating a clean immigration history with no instances of overstaying. Furthermore, there should be no intention to remain in the UK after the expiration of the spouse or relative's visa.

 

Steps to Apply

Applications for the Skilled Worker dependent visa can be submitted with the primary Skilled Worker visa application or at a later time. Irrespective of the timing of the submissions, approved applicants will be granted leave that aligns with the duration of the primary visa holder's leave.

The approval timeline may vary depending on the location where the Tier 2-based visa approval is sought.

As a holder of the Skilled Worker dependent visa, you are entitled to:

  • Reside in the UK for the same period as the principal Skilled Worker visa holder.
  • Engage in employment, with specific exceptions.
  • Pursue studies or undertake a postgraduate course, subject to certain conditions.
  • Apply for visa extension in alignment with the principal applicant, provided the eligibility criteria are met. Extension applications are not permissible once the key visa holder has departed from the UK.
  • Restrictions include ineligibility for public funds, along with prohibitions on working as a trainee doctor, dentist, or professional sports instructor.
