Can spousal separation affect your Canadian dream?

Couples must sign an agreement before signing up as sponsors while taking responsibility for providing financial support to the partner and the dependent children.

 

It is important to note that the couple must beforehand agree for the sponsored person to refrain from availing any assistance from the Canadian government. If done so, the sponsor would have to repay all the charges taken during the tenure.

 

Some of the basic requirements that need to be taken care of by the sponsor are as follows:

  • Food
  • Shelter
  • Clothing
  • Other daily living essentials
  • Dental care
  • Eye care
  • Other healthcare that are not funded by the health services

 

 

The Undertaking Process

The undertaking is the sponsor's commitment to look after the applicant's needs and necessities throughout the procedure.   

 

The duration of undertaking for a spouse or partner is three years, starting from the day the sponsored person acquires a PR. However, the duration of undertaking differs for Quebec residents compared to the other provinces of Canada.

 

 

The undertaking cannot be canceled or called off even if:

  • If you separate, take a divorce, break the relationship with your partner, or sign for an annulment of your marriage.
  • If you and your chosen sponsor move to another Canadian province or state
  • If the sponsored person gains Canadian citizenship
  • If you have financial burdens

What happens if your relationship proves to be a sham?

The IRCC officer examines and evaluates the relationship's authenticity when applying to be a sponsor. The relationships or spousal marriage arrangements will be rejected or refused if found to be unlawful or bogus.

The applicant must provide a set of documents to the IRCC officer to prove the legibility of the relationship.

 

The checklist of requirements that must be presented is as follows:

 

  • Wedding Invitation
  • Proof of joint ownership of a residential area
  • Proof that both the sponsor and the applicant reside at the same address
  • Evidence of a joint account (Banks, taxes, cell phone bills, etc.)

 

Most often, sponsors and the applicants get involved in a marriage of convenience wherein the only purpose of the relationship is for the applicant to immigrate to Canada.

Marriage fraud is another alarming scam wherein a citizen of Canada or a permanent resident is lured into a relationship or marriage and is rejected after the completion of the immigration process. 

 

One can always contact the IRCC in such cases, and severe consequences will be determined for the sponsors.

 

Some of the actions that the IRCC will take are:

 

  • Charge them with a crime
  • Forbid them from the country for 5 years
  • Abolish them from the country
  • Remove their PR or citizenship status
