USCIS extends processing of work authorization for few F1 visas

Highlights: Premium processing of work authorization for some F-1 visa holders

• USCIS announced to allow specific F-1 Visa holders to choose the premium processing of work authorization.
• Selective foreign students can now avail of premium processing of work authorization.
• F-1 Visa holders seeking OPT & STEM-OPT with a pending Form-I-765 can also avail of this upgrade.
• The premium processing will start from the 6th of March and from the 3rd of April in some categories.

Expansion of Premium processing for F-1 Visa

The expansions will start on March 6th and April 3rd for a selective group of categories.

March 6th, 2023

The USCIS will accept the I-907 requests either via the online mode or in the form of paperwork.

The selective F-1 students with an awaiting Form I-765, Application for Employment Authorization can apply under the categories listed below –

• (c)(3)(A) – Pre-Completion OPT;
• (c)(3)(B) – Post-Completion OPT; and
• (c)(3)(C) – 24-Month Extension of OPT for STEM students.

April 3rd, 2023

• The USCIS will accept form I-907 requests via an online or offline application copy for F-1 Visa under the categories mentioned above alongside Form I-765.
• If the awaiting Form I-765 is submitted before March 6th, the USCIS will reject the request.

Green Card Premium Processing

• In January, the US administration extended the premium processing of applicants for a green card and other visa categories related to international student training.
• These categories are extended in phases for EB-1 and EB-2 applications for Green Cards.
• This program was added to the existing I-140 petitions filed under the E-13 (multinational executive and manager classification) and the E-21 category.
