The second stage of Skilled Worker Immigration Law in Germany

With the second stage of the Skilled Worker Immigration law in effect from March 1, 2024, skilled workers are now eligible to work in their field of expertise and settle in Germany. The first stage, introduced in November 2023, recognised skilled workers and facilitated the EU Blue Card.

 

The Federal Minister of the Interior and Homeland, Nancy Faeser, commented that Germany needs foreign workers, especially in the nursing field, to meet the country's economic needs. 

 

Recent reports by Reuters published in November 2023 reported a vacancy of 1.8 million job positions in Germany.

Skilled Worker Immigration Law welcomes foreign workers

The Second stage of Skilled Worker Immigration Law has made it possible for experienced professionals to work and migrate to Germany.

With a minimum professional experience of two years and a professional University degree, a skilled worker can come to Germany under the new Skilled Worker Immigration Law. Some of the other eligibility criteria include fulfilling the salary threshold.

 

Benefits of the New Skilled Immigration Law

The New Skilled Workers Immigration Law is to offer the following benefits:

• Skilled workers can bring their parents to Germany.
• Proof of sufficient accommodation is no longer required when bringing children or spouses.
• Easier labour market access for care sector workers.
• Recognizing qualifications in advance for healthcare and nursing professionals is no longer mandatory. The process can be completed upon their arrival in the country. 
• Non-EU nurses with less than three years of experience are eligible to work in the health and care sector.
• Students can do part-time jobs with more time to complete their study procedures for acquiring professional qualifications.
• The priority examination in vocational training courses will be abolished.
• Apprentices can apply for a second job of up to 20 hours per week.
• Students can work up to 20 hours per week as the annual working time will increase to 140 full days or 280 half days.

Initiatives to curb labour shortage in Germany

According to a recent report by SchengenVisaInfo, around 150,000 nursing staff vacancies are expected in Germany by 2025. Several strategies and agreements have been introduced to attract foreign workers from countries like Vietnam, Indonesia, Brazil, and the Philippines.

 

The New Skilled Workers Immigration Law permits employers to hire 25,000 foreign workers in 2024 to tackle the labour shortage in the country. Foreign workers in Germany are eligible to work for eight months, provided the working week is at least 30 hours. In such cases, the employer must pay the employee all necessary travel expenses.
