  • IRCC announced a new temporary public policy on March 18, 2024, proposing several changes.

IRCC’s New Temporary Public Policy

On March 18, 2024, IRCC announced a new temporary public policy stating that the extra H-1B open work permit applications received in July 2023 will be processed. 

 

The IRCC is to process the following types of applications:

  • Extra applications that were submitted after reaching the cap count on July 17, 2023
  • Work permit applications for family members, including those who have already applied for a work permit or are willing to apply within 12 months
  • Applications submitted by immigration representatives on behalf of the applicant and their family members through the Authorized Paid Representatives Portal before the cap count was met on July 17, 2023

 

Under the new temporary public policy, IRCC has also announced a fee waiver on the study permit processing fee. H-1B holders who had initially applied for the H-1B open work permit measure can now apply for a study permit for their minor children from within Canada without the need to pay the processing fee for a study permit application.

 

According to IRCC, this move is to help H-1B applicants apply for study permits for their minor children who were previously unable to apply.

Canada’s Tech Talent Strategy

The Tech Talent Strategy was launched in Canada on July 16 last year to bring temporary workers in the tech sectors from the US. It created an open work permit stream, mainly targeting international workers in the US working with specialty occupation visas, which most of the companies in Silicon Valley use to bring in highly skilled immigrants.

Work and study permit options were also available for the family members of workers under this new stream. According to the reports by IRCC, only principal applicants made it to the application cap with a maximum of 10,000 application submissions within one day.
