Temporary Foreign Worker Program (TFWP)

The Temporary Foreign Worker Program (TFWP) allows employers in Canada to hire skilled foreign workers temporarily. The hiring is done depending on the labor shortage situation in the country.

 

The primary requirement to qualify as a temporary foreign worker is to possess a Labor Market Impact Assessment (LMIA). The LMIA is an official document that must be acquired by the Canada-based employer from the Canadian government.

 

IRCC announced new wage-related changes for temporary foreign workers, wherein LMIA applications submitted by January 1, 2024, must be updated with the latest wages.

 

Some of the jobs or occupations are exempted from the LMIA requirement. The three categories of jobs that are LMIA-exempt are as follows:

 

• Jobs that are a part of the international trade agreement.
• Jobs that are tied with the Federal, territorial, or provincial governments.   
• Jobs that are in the best regards of Canada

Temporary Foreign Worker Rights

Canada protects the rights of temporary foreign workers by ensuring everybody gets grants and rights equal to those of Canadian residents.

 

Employers recruiting Temporary Foreign Workers must:

• Provide details of the worker's rights.
• Provide signed copies of employment agreements.
• Pay the workers as per the job contract
• Ensure the worker gets a comfortable working environment  
• Follow the employment and hiring standards set by the provinces/territories
• Pay for private medical insurance
• Ensure the worker gets access to healthcare services in case of emergencies.

• Force the worker to work even when they are sick or ill
• Force the worker to take part in dangerous or unsafe work.
• Pressurize the worker into working overtime
• Penalize the worker for voicing out any concerns regarding ill-treatment, unsafe work environment, etc.
• Seize the work permit or passport of the worker
• Change the immigration status or deport the worker from the country
• Force the worker to reimburse employment-related fees.
