  • The Canadian Citizenship law changes for the first-generation limit (FGL) are now delayed till August 2024.
  • The FGL rule states that if a citizen of Canada born outside the country has a child outside Canada, the child will not directly inherit citizenship.
  • An initial deadline of June 19, 2024 was assigned to the earlier order issued by the Ontario’s Supreme Court related to the FGL.
  • Other specific changes have already been implemented to reform the FGL rule.

Changes to Canada’s First-generation limit (FGL)

The changes expected to be announced for the First generation limit (FGL) is now delayed till August 2024. As per the FGL, if a citizen of Canada was born outside Canada and births a child outside the country, the child does not automatically acquire citizenship from their parents.

The court found it unjust as it created a lower citizenship class. The date assigned a deadline of June 19, 2024, to come up with a solution.

However, the Federal government has extended the deadline to August 1, 2024, to decide if the extension until December would be the right choice. The judge also asked for a report regarding the implementation process of Bill C-71.

Previously implemented changes

Some changes have already been announced to modify the FGL that can grant Canadian citizenship to foreign citizens. The changes were announced on May 30, 2024, facilitating a “discretionary grant of citizenship” to applicants who have previously applied for a fast processing of their citizenship application.

The measures are for two specific situations:

Situation 1: The candidate has already submitted proof of the Canadian application that is subject to the FGL rule and has requested for an urgent processing by fulfilling the criteria for it.  

Situation 2: The candidate has proof of application currently in process with the IRCC and recognizes that the application is affected by the FGL law. The application must have previously been non-prioritized until the new rule is implemented; however, the candidate has applied for urgent processing since then.
