Australia mandates Genuine Student requirement from March 23, 2024 for international students

• Australian Government will replace Genuine Temporary Entrant (GTE) with the Genuine Student (GS) requirement.
• The Government of Australia released the Migration Strategy on December 11, 2023, announcing the replacement.

Australia’s Genuine Student Requirement

The Migration Strategy released by the Australian Government on December 11, 2023, announced the replacement of the Genuine Temporary Entrant (GTE) with the Genuine Student requirement. 

 

The new student Visa application requirements will commence on or after March 23, 2024, while the current GTE requirements will be followed for students applying before March 23, 2024. The Student Guardian Visa applicants must also follow the new GTW requirement. 

 

The new GS requirement aims to identify international students who genuinely intend to acquire quality education in Australia without any reference or confusion about further migration plans.

Changes under the new GS requirement

The student visa application will have some targeted questions instead of the current 300-word statement. The questions would help analyze the students' intention for willing to study in Australia. 

 

The answers should clearly state the student's intentions and must be supported with documentary evidence for the visa decision-makers to decide.  

 

The intended questions must cover the following:

• Information on the current circumstances, including family ties, economic and employment conditions, and community details. 
• Reasons for choosing Australia as their study destination with a clear explanation. 
• Benefits of the course selected by the applicant
• Details of your study history in Australia (if applicable)
• Reasons for applying for a student visa in cases where the applicant possesses a different visa. 
• Any other relevant information the applicant feels necessary to provide.

Amendment of the Student Visa Declaration

Under the new GS requirement, the student visa declaration provided by the student should confirm the following:

• The applicant clearly understands what it means to be a genuine student in Australia.
• The applicant has read, understood, and is committed to the student visa conditions.
• In case of any change in their circumstance, the applicant must notify the Department of Home Affairs.
• The applicant understands that only a limited number of graduates would be eligible for permanent migration after completing their studies in Australia.
• The applicant will depart the country if they are found ineligible for a lawful residence in Australia.

 

The current Ministerial Direction No. 69 will be withdrawn with the implementation of two new ministerial directions:

• One of the ministerial directions will announce the implementation of the GS requirement for applications made on or after March 23, 2024.
• The other ministerial direction will ensure that the GTE assessments are observed for applications made before March 23, 2024.

 

Note: Changes are expected to be announced in English language requirements for Temporary Graduate and Student Visa applicants.
